By accessing and using ImageRat ("the Site"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site.
Description of Service
ImageRat provides a platform for users to upload, share, and view images ("the Service"). You understand and agree that the Service is provided "as-is" and "as available".
User Obligations and Conduct
- Age Requirement: You must be at least 18 years old to use the Site.
- Prohibited Content: You agree not to upload, share, or otherwise make available any content that:
- Violates any applicable laws or regulations.
- Infringes on any third party's intellectual property rights.
- Contains nudity, pornography, or sexually explicit material.
- Promotes violence, hate speech, or discrimination.
- Contains malware, viruses, or any other harmful software.
- Is defamatory, libelous, or invasive of another's privacy.
- Depicts or encourages illegal activities.
- Contains copyrighted material.
Content Ownership and License
- User Content: By uploading User Content, you grant ImageRat a worldwide, non-exclusive, royalty-free license to use, distribute, reproduce, and display the content in connection with the Service.
Content Moderation
- Monitoring: ImageRat reserves the right to monitor and review User Content. We may remove any User Content that violates these Terms or is otherwise objectionable.
No Account or Deletion Option
- No Account Requirements: ImageRat does not require users to register or create an account to use the Service.
- No Deletion Option: Once images are uploaded to the Site, users do not have the option to delete them. Ensure you are certain about sharing content before uploading.
Disclaimers and Limitation of Liability
- As-Is Basis: The Service is provided on an "as-is" and "as available" basis. We make no warranties, express or implied, about the Service's reliability, availability, or suitability for any purpose.
- Limitation of Liability: To the fullest extent permitted by law, ImageRat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.
Indemnification
You agree to indemnify, defend, and hold harmless ImageRat, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any third party.
Waiver of Class Action
- No Class Actions: You expressly waive your right to file a class action or seek relief on a class basis.
